Review and accept end-user license agreements.


Overview

End-user license agreements (EULAs) are legal contracts between a provider and a product user. It specifies in detail the rights and restrictions that apply to the product.

Accept end-user license agreements

  1. Open the console.
  2. In the upper right corner, click your workspace name → EULA.
  3. To read the document, click the link in the Name column. This will initiate a file download to your device.
  4. To accept the document, click Accept EULA.

If the EULA is updated, you’ll have to accept the new version to be able to order new data from a given collection.

View accepted end-user license agreements

  1. Open the console.
  2. In the upper right corner, click your workspace name → EULA.
  3. To display the accepted EULAs at the top, double-click the Status column header.

Access and limitations

Compliance

If your organization has passed the compliance check and requested and received access for a specific collection, then you can order the data.

Data renewal

Any data acquired through UP42 is stored within our data management system.

Technical limitations

Any limitations on the order geometry or minimum order are already covered by our catalog and tasking conditions. Our geographic coverage and restrictions maps detail any geographic limitations a given collection has.

EULA parties

Licensor

The provider that distributes the geospatial data and allows to use it under certain terms and conditions.

Licensee or end user

The organization that accepts the EULA and obtains a license to use the geospatial data from the licensor.

When you accept a EULA, you confirm to the licensor that you have the legal right to agree to this contract on behalf of your organization.

License conditions

The products are licensed, not sold. It means that the licensee isn’t buying the product — they are granted the right to use it.

Most licenses have the following characteristics:

  • Non-transferable

    The licensee can’t transfer the license rights to another party.

  • Non-sublicensable

    The licensee can’t sublicense this data to others.

  • Non-exclusive

    The licensor can grant the same license to others.

  • Revocable

    The licensor can revoke the license, if its terms and conditions or any applicable regulations were violated. Otherwise, the EULA’s duration is unlimited.

Types of licenses

Standard license

A standard license doesn’t require any prior validation from the licensor.

The standard license is applicable to most use cases. It’s always available on the UP42 platform by default.

On-demand license

An on-demand license requires prior validation from the licensor.

Media, academic, or technical evaluation licenses aren’t a part of the EULA provided on the UP42 platform. They might have different pricing.

Internal vs. external use

  • Internal use

    Employees, consultants, and contractors of the organization use the data for internal purposes.

    Examples of internal use include developing value-added or derivative products, using data in internal reports or presentations, or analyzing it for organizational research. In any case, reverse-engineering or any other attempt to derive the source code isn’t allowed.

  • External use

    The data is distributed or sold to parties outside the licensee’s organization. The respective EULA determines its allowed purposes.

    Examples of external use include selling images to customers or publishing images on a public website. Usually, external distribution requires that no geolocation information be associated with the data.

Attribution

Licensed data requires attribution to acknowledge the licensor’s intellectual property rights, such as when data is used in publications, reports, or analyses. Attribution typically takes the form of a copyright notice or a public notice, in the case of a public license. Licensors specify the required format for the copyright notice in their license.

Attribution is always required for original data products and value-added products and sometimes for derivative products. Sometimes an indication is required that the original data product was modified.

For media use, a media license is required.

Troubleshooting

Can I use an image in publicly distributed materials?

The standard EULA doesn’t account for media licensing. Contact the Sales team to discuss options.

I’m doing research. Can I get an academic license?

Check if ESA’s Network of Resources is applicable to your case. If not, contact the Sales team to discuss options.

Can I resell the data I ordered?

No, but you can use the original data product for your own internal business purposes.

Can my client access the data I ordered?

No, your client must order the data themselves if they need access and then add you to their account. You can act as their contractor but can’t provide the data directly.
